New Jersey has emerged as a leader in progressive cannabis legislation, establishing a robust regulatory framework that governs both medical and recreational cannabis use. This comprehensive system is designed to balance public health and safety, economic opportunity, and social equity, ensuring that cannabis is accessible in a controlled and responsible manner.
Recreational Cannabis in New Jersey
Who Is Eligible to Purchase?
Both residents and visitors who are at least 21 years old are eligible to purchase cannabis. Purchases must be made at state-approved dispensaries.
What Can Be Purchased?
Each transaction at a licensed dispensary allows the sale of up to 28.35 grams (or 1 ounce) of usable cannabis. This limit applies across various forms of the product. For example, the limit may be met by buying:
- 28.35 grams (1 ounce) of dried flower,
- 4 grams of solid concentrates or resin,
- 4 grams equivalent of liquid concentrate (measured in milliliters),
- 4 grams of vaporized formulations (such as oils), or
- 1,000 milligrams of cannabis-infused edibles (for instance, 10 packages of 100 mg each).
Customers can also mix different product types as long as the combined amount does not exceed the set limits—for instance, combining a half-ounce of dried flower with a smaller amount of concentrate.
Possession Limits and Measurements
Under New Jersey law, an individual may legally possess up to 6 ounces of cannabis and related products at any time. Commonly used retail measurements include:
- An “eighth” (approximately 3.5 grams),
- A “quarter” (around 7 grams), and
- A “half” (roughly 14 grams).
Pricing and Taxes
The final price of cannabis products varies based on location and product type. All purchases are subject to a state sales tax of 6.625%, in addition to a social equity excise fee set at roughly one-third of 1%.
Purchase Records and Identification
Dispensaries require a government-issued ID to verify that the purchaser is 21 or older. However, they are not permitted to retain or copy your identification beyond what is necessary for completing the transaction. While customers may voluntarily sign up for loyalty or mailing programs, no personal information is stored as part of the sale.
Consumption and Transportation Rules
Cannabis consumption is permitted in private settings; however, property owners such as landlords may choose to prohibit use on their premises. It is important to note that transporting cannabis across state lines remains illegal under federal law.
